Dubai has enacted new regulations for trading virtual asset derivatives, such as cryptocurrencies.
Dubai Pioneers Global Virtual Asset Derivatives Regulation
Dubai has taken a pioneering step globally by introducing a regulatory framework specifically for virtual asset derivatives trading.
The Dubai Virtual Assets Regulatory Authority (VARA) announced on Tuesday that the framework covers Exchange Traded Derivatives (ETDs). Accordingly, Virtual Asset Service Providers (VASPs) can offer these products to customers within a defined legal framework, subject to obtaining necessary approvals and complying with regulations. These regulations are included in version 2.1 of VARA's Exchange Services Rulebook and are immediately enforceable for all licensed exchanges in Dubai.
New Rules for Trading and Risk Management
The new rules establish stringent requirements for risk management and market integrity, the most important of which are:
Customer Assessment and Classification: Developing standards for assessing customer suitability, especially before entering high-risk transactions.
Control of Financial Instruments: Close monitoring of margin, leverage, and liquidation processes to control market risks.
Asset Segregation: Requiring providers to fully segregate customer accounts and assets to reduce systemic and counterparty risks.
Enhanced Transparency: Requiring accurate information disclosure and strengthened communication with customers, in line with current marketing regulations.
Right of Legal Intervention: Granting VARA the legal authority to intervene directly in critical market conditions or in the event of violations.
Regulatory Outlook and Transparency
VARA emphasizes that this framework is designed to ensure that innovation in the virtual asset sector progresses in tandem with governance and transparency requirements.
It is emphasized that this set of rules applies to all entities licensed by VARA within Dubai, but the existence of this framework does not imply endorsement or guarantee of any particular product or service by the regulatory authorities.
